ShowingNow Terms & Conditions

This Agreement is a binding contract between you and ShowingNow LLC, a Florida limited liability company. This Agreement governs your use of the ShowingNow mobile application, website, web portal, and any related services (collectively, the Platform). By creating an account or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions and our Privacy Policy.

Eligible user types: Initiating Agent (a real estate agent or broker actively licensed in the U.S., using the Platform to request showing coverage for their clients); Property Manager (a person who oversees real estate, using the Platform to show properties to potential renters); Client (a person or company viewing real estate for themselves); Showing Agent (a licensed real estate agent who opens properties for Initiating Users in exchange for compensation); Brokerage (a licensed real estate brokerage using the Platform to manage their agents showing activity). By using the Platform you represent that you are 18 years of age or older and accept these terms as legally binding. You may be subject to identity and licensure verification through third-party services.

Showing Agents are independent contractors, not employees, agents, joint venturers, or partners of ShowingNow or any Initiating User. ShowingNow does not control the manner, means, or method by which Showing Agents perform their services. Nothing in this Agreement creates an employer-employee relationship. ShowingNow is a technology marketplace that facilitates connections between Initiating Users and Showing Agents. ShowingNow does not itself provide showing services and makes no representations regarding the quality, safety, or legality of services performed by Showing Agents.

Initiating Users submit showing requests via the Platform. Requests are broadcast to eligible Showing Agents in the area until one accepts. Showing Agents must hold an active, valid real estate license; remain at the property for the full duration of the scheduled showing or open house; not represent, advise, or hold themselves out as an agent for any buyer or seller; and comply with all applicable FREC rules and real estate laws. Initiating Agents must inform their clients that the Showing Agent is not their representative; ensure they are legally permitted to request showing coverage; and provide accurate property information, access instructions, and scheduling details.

No charge applies if an Initiating Agent cancels 4 or more hours before the scheduled start time. A full charge applies if cancelled less than 4 hours before the scheduled start time. If no Showing Agent accepts a request before the scheduled start time, the Initiating Agent will receive a full automatic refund. ShowingNow does not guarantee that a Showing Agent will be available for every request. If a Showing Agent fails to appear without cancelling in advance, the Initiating Agent will receive a full automatic refund. Repeated no-shows may result in suspension or removal from the Platform. If a Showing Agent cancels after accepting, no charge is applied to the Initiating Agent.

All payments are processed through Stripe, Inc. ShowingNow does not store full payment card information. When an Initiating Agent selects the ShowingNow suggested rate, the amount charged may differ from the amount paid out to the Showing Agent. ShowingNow may apply a dynamic spread between the charged rate and the Showing Agent payout based on real-time supply and demand conditions. This spread represents ShowingNow service fee and is not disclosed separately at the time of the transaction. When an Initiating Agent sets a custom rate, the Platform will display the exact amount the Showing Agent will receive prior to submission. No spread is applied to custom rate requests. Showing Agents receive an email notification of their payout the next day following a completed gig. Actual disbursement timing depends on the payout method selected and is subject to standard banking timelines including ACH processing windows which may take 1-3 business days. ShowingNow is not responsible for delays caused by the Showing Agent bank or payment provider. Tips are processed via Stripe and passed in full to the Showing Agent.

By registering and providing your phone number, you consent to receive transactional SMS messages related to your gig activity. Standard message and data rates may apply. You may opt out of marketing SMS at any time by replying STOP. You consent to receive electronic notices and legal communications from ShowingNow electronically.

ShowingNow grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for its intended purpose. You may not copy, modify, or create derivative works; reverse engineer or decompile; remove intellectual property notices; use the Platform in violation of applicable law; or scrape or systematically extract data from the Platform.

By submitting profile information including your first name, profile photo, star rating, and years of experience, you acknowledge and agree that this information will be visible to other users of the Platform. You are responsible for ensuring any profile photo you upload is appropriate and that you have the right to use it. You represent and warrant that you will use your legal name, act professionally, fulfill all commitments, and comply with all applicable laws. You grant ShowingNow a non-exclusive, royalty-free license to use content you submit to operate and improve the Platform. You agree to indemnify and hold harmless ShowingNow LLC and its officers, directors, employees, and agents from any claims arising from your breach of these Terms or your use of the Platform.

THE PLATFORM IS PROVIDED AS IS AND AS AVAILABLE WITHOUT WARRANTIES OF ANY KIND. SHOWINGNOW DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE. SHOWINGNOW DOES NOT SUPERVISE OR CONTROL THE SERVICES PERFORMED BY SHOWING AGENTS AND DISCLAIMS ALL LIABILITY FOR THE ACTS OR OMISSIONS OF ANY SHOWING AGENT OR INITIATING USER.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SHOWINGNOW LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Either party may terminate this Agreement at any time. ShowingNow may suspend or terminate any account at any time with or without notice for conduct that violates these Terms or is otherwise harmful to the Platform or its users.

This Agreement is governed by the laws of the State of Florida. Any legal action must be brought in the state or federal courts located in Palm Beach County, Florida. Claims must be filed within one year of the cause of action.

Severability: If any provision is unenforceable, the remaining provisions remain in full force. Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between the parties. Waiver: No waiver of any term is effective unless in writing signed by ShowingNow. Updates: ShowingNow may update these Terms at any time. Continued use after notice constitutes acceptance.
